Professional experience

Marco Gagliardi has extensive experience in auditing and consulting, specializing in financial market law, with a focus on banks, collective asset managers, asset managers, and FinTech companies. He is also involved in conducting FINMA investigation and audit mandates, prepares legal opinions, and assumes the compliance function for collective asset managers and asset managers.

He started his career as an auditor at a Zurich district court and as a trainee at a major law firm in Zurich, where he worked in the field of transactions. Before joining Grant Thornton Switzerland/Liechtenstein, he worked for several years as a legal advisor at an auditing and consulting firm in the field of regulatory & compliance, as well as a lawyer at a Zurich law firm specializing in banking law and anti-money laundering compliance.

Professional qualifications and memberships

Marco Gagliardi holds a Master of Law (MLaw) from the University of Zurich and is admitted to the Zurich bar. In autumn 2023, he also successfully completed the CAS "Financial Market Law" at the University of Zurich.

Languages

In addition to his native German, Marco Gagliardi speaks very good English.

Cyber attacks - FINMA calls for increased cyber risk measures at supervised institutions

Regulatory & Compliance

The number of successful cyber attacks has been increasing for years. Cyber attacks are therefore one of the main risks for FINMA-supervised institutions. The new FINMA Guidance 03/2024 now describes specific requirements for dealing with cyber risks and answers common questions about reporting obligations. Although it is aimed at larger and more highly regulated institutions such as banks, the principles are also applicable as a guidance to smaller and medium-sized portfolio managers (Art. 17 of the Financial Institutions Act [FinIA]). In particular, the boards of directors of the institutions must also be prepared.
